In April–June 2026 (Q1 2026/27, provisional), 45.7% of ESA appeals cleared at a hearing were decided in the claimant's favour, and 53.9% upheld the DWP decision (HMCTS official statistics). ESA overturn rates are materially lower than PIP's (67% in the same quarter) — the two benefits have different case-mixes, so never plan an ESA appeal around PIP odds.

What is the ESA50 and do I get to see it?

Can I get ESA backdated after a successful appeal?

Where a decision is changed in your favour at MR or tribunal, payment is normally backdated to the date of the original decision, not the date you appealed. If your appeal is successful at tribunal, the DWP is notified and should implement the tribunal's decision.
